The following terms and conditions govern the use of the 3VR Security, Inc ("3VR") web sites and any materials or information accessed, downloaded, or provided by the user via the web sites. Use of the site constitutes acceptance of these terms and conditions. These terms and conditions may be revised at any time and any revised agreement is effective upon the user accessing a 3VR web site.

Use of Materials

This web site contains material such as text, images, video, and software that are protected by copyrights, trademarks, and other proprietary rights. 3VR has no obligation to monitor a user's use of the web site or the content provided or created by any user. However, 3VR reserves the right to monitor, retain, or discard information pertaining to such use. Likewise, 3VR makes no representations with respect to the accuracy of the information on the website nor should any statement regarding products and services offered by parties other than 3VR, or links to the web sites of other parties, be construed to constitute an endorsement or recommendation. In no event shall 3VR, its directors, officers, employees or agents be liable for any damages or consequences even if 3VR or an authorized representative shall have been advised of the possibility of such.

Exclusion of Warranties

The materials provided on this web site are provided without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

Indemnity

User agrees to indemnify and hold 3VR, its members, affiliates, officers, and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of user's conduct.

Copyright Infringement Notification Procedures

All users of the site will comply with copyright laws. In the event 3VR receives proper notification of claimed copyright infringement, the response to such notice may include removing or disabling access to material claimed to be the subject of infringing activity and possibly terminating the right to use 3VR web sites.

If a user believes that material on the site constitutes a copyright infringement, the user may file a notice of infringement to the contact identified below. A user who materially misrepresents that material is infringing will be liable for the costs incurred by 3VR and its associated persons, including attorney fees. The provider of the allegedly infringing content an may make a counter notification. A provider who materially misrepresents that material is not infringing will be liable for the costs incurred by 3VR and its associated persons, including attorney fees. The counter notification must be a written communication, by fax or regular mail, that sets forth the following:

    3. Make the following statement: "I consent to the jurisdiction of Federal District Court for the [insert the federal judicial district in which your address is located]";
    4. Make the following statement: "I will accept service of process from [insert the name of the person who submitted the infringement notification] or his/her agent";
    5. Make the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled"; and sign the document.

    Complaints Regarding Content

    Should any person believe that any content on the site is inaccurate, defamatory, infringing or otherwise problematic, they may send a written communication setting forth their concerns to:

    3VR will consider the issues raised by the communication, and at its sole discretion, may alter the content and respond to the communication.

    Termination

    3VR may terminate user's access to all or part of this site without notice, for any conduct that 3VR, in its sole discretion, believes to be harmful to other persons, 3VR, or any of its affiliates. 3VR may also terminate or suspend user's account for inactivity, which is defined as failing to sign-in for an extended period of time, as determined by 3VR. If user wishes to terminate an account, user may send an e-mail to 3VR to request that their account be removed. Otherwise, the only recourse is to discontinue use of the web site.

    General Provisions

    If any part of this agreement is determined to be invalid or unenforceable by a court or arbitrator, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

    In the event that a dispute between the parties must be resolved by a court, the parties hereby agree to submit any such dispute to the exclusive jurisdiction and venue of the courts located in San Francisco, California.
